Chemours Company is the recipient of the U.S. EPA’s first-ever enforcement action for PFAS discharges with the Clean Water Act (CWA). The Department of Defense (DoD) conducts sampling of drinking water off-base to ensure it identifies potential impacts of PFAS resulting from DoD activities. Off-base drinking water includes non-DoD drinking water systems and private wells located outside the installation boundary. The DoD provides final test results of off-base drinking water in accordance with Section 345 of the National Defense Authorization Act for Fiscal Year 2022.

The U.S. Environmental Protection Agency (EPA) formally announced the issuance of the next Toxic Substances Contract Act (TSCA) test order requiring PFAS testing. The new test order is being made under the National PFAS Testing Strategy. The EPA announced the action on January 4, 2023, which orders companies to conduct and submit testing for the PFAS substance HFPO. HFPO (CAS # 428-59-1), also known as trifluoro(trifluoromethyl)oxirane, is used in plastics manufacturing.
